The operator and organizer of the "Advent Calendar" promotional campaign (hereinafter: "Campaign") is Allegro sp. z o.o. with its registered office in Poznań, at ul. Wierzbięcice 1B, 61-569 Poznań, entered in the Register of Entrepreneurs kept by the District Court for Poznań – Nowe Miasto i Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number 0000635012, share capital: PLN 40,000,000, Tax Identification Number (NIP): 525-26-74-798, National Business Registry Number (REGON): 365331553 (hereinafter: "Company").
The Campaign runs from December 1, 2024, 8 a.m. (GMT + 01:00) until December 24, 2024, 11:59 p.m. (GMT + 01:00).
The Campaign is addressed to Partners who meet the following conditions together:
a. have an active Business Account on Allegro;
b. Achieve Sales Quality of at least the Neutral level in the Business Account referred to in sub-paragraph (a) above.
c. Have no arrears towards the Company for the use of services available on Allegro;
d. they read and accepted these Terms & Conditions, received by email to the address indicated as part of current working relations.
Detailed criteria of submitting Offers for the Campaign:
a. Submitting for sale only active Offers listed on Allegro at a given moment;
b. determine the required parameters for the Goods,
c. determining the required parameters for the Offer, i.e., Condition > New, Offer type > Buy Now,
b. when submitting an Offer for Campaign, the Partner should propose a price taking into account the following criteria:
The price reduced by at least 15 % compared to the price of a given Good calculated by the Company on the basis of analytical data, taking into account the lowest prices of these Goods on Allegro and outside Allegro (information on this data can be obtained by the Partner in the course of ongoing contacts with the account manager)
The price reduced by at least 10% compared to the lowest price of the Goods in the Offer from the last 30 days before the submission (this price will be visible in the Offer as a crossed-out price)
Have an active SMART! badge — Offers must meet the Allegro Smart! delivery or free delivery for the entire duration of the Campaign
The Company reserves the right to verify at any time whether an Offer which has been qualified to participate in the Campaign still has the active SMART! In the event that an Offer loses such status, the Company reserves the right to remove it from the Campaign, and the benefits for the Partner's participation in the Campaign will be billed only for the period during which the Offer in question met the Campaign’s terms and conditions.
Offers for the Campaign are selected from Offers with an EAN code and linked to the Allegro Product Catalog as indicated in the article on the website), based on the verification of the prevailing sales trends in the Allegro categories, including seasonality, the uniqueness of the Goods, the Goods' selling potential on Allegro, the recognizability of the Goods, how often they are searched for by Buyers, the quality of the Goods (including the quality of the material from which they are made), whether the Goods have relevant shipping terms, the warranty period, the quantity of Goods in the Offer, the quality of the description, images, the Offer template, and the value of products added to the Offer as freebies.
The details of the promotion of Offers qualified for the Campaign are determined individually by the Partner with the Account Manager within ongoing working cooperation between the Parties.
By submitting an Offer for the Campaign, the Partner agrees to reduce the price of the Goods in the Offer covered by the Campaign (this is a technical activity in the system tool performed by the Company on the basis of the Partner’s indication), and to enable the purchase of this Goods at the reduced price by Buyers with an active Allegro Smart! membership, exclusively via the Allegro mobile application.
For offers participating in the Campaign, the Partner is obliged to correctly establish the number of items declared for the promotion in the Offer not later than 24 hours before the start of the promotion. For Offers where the start of the promotion is scheduled for Saturday, Sunday or a holiday, this will be the business day preceding the start of the promotion.
Offers qualified for the Campaign receive a special badge: "Smart! in the app".
A purchase limit for buyers will be imposed in all Offers submitted for the Campaign in accordance with the Partner's suggestion
The Company stipulates that the price in the Offer submitted for the Campaign may not be changed if the Participant's Account has any functionality restrictions imposed, and the required parameters, such as the complaint procedure, warranty, delivery, or mandatory Goods parameters, have not been completed.
For participating in the Campaign, the Partner will obtain the following benefits:
a. A 99% refund of the sales commission for the Goods, calculated in accordance with Appendix No. 4 to the Allegro Terms & Conditions. The bonus will be awarded to the Partner's account in their Allegro Account, and will be calculated on the fees charged on the Partner's account after the sale of Goods;
b. A refund of 100% of the additional sales commission for Offers with Promoted Products with an additional Feature option — the bonus will be awarded immediately to the Partner’s account in their Allegro Account;
c. No additional sales commission for the sale of Promoted Products in the Allegro Deal Zone Program;
d. Presentation of offers with the "Smart! in the app" badge in promotional areas within Allegro made available for the Campaign.
The benefits granted as part of the Campaign do not add up to other rebates or benefits granted as part of other promotional Campaign’s organized by the Company. In addition, the maximum commission rebate which the Partner may obtain in a given calendar month as part of the Campaign, including in combination with a rebate obtained as part of other promotional Campaign’s organized by the Company, may not exceed the total value of fees and commissions charged by the Company for the use of services available at Allegro in the same calendar month.
The granting of benefits referred to above does not affect the Partner's obligation to pay fees provided for in the Allegro Regulations, in particular Attachment No. 4 to the Allegro Regulations.
The Company is the controller of the Partners' personal data in connection with their participation in the Campaign, within the meaning of Article 4(7) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). Information on personal data processing rules is provided in the Privacy Protection Policy constituting Appendix No. 5 of the Allegro Terms & Conditions.
Any complaints related to the Campaign should be lodged in writing within 14 days of the incident being the basis for the complaint, via the contact form.
If the Offer does not meet the criteria referred to in this paragraph 6, the Company allows the possibility of qualifying the Offer for the Campaign on the basis of the Company's decision. Such decision will be based on a verification of the attractiveness of the price of the listed Goods with respect to market and Allegro prices, the prevailing sales trends in the Allegro categories, including seasonality, the uniqueness of the Goods, the Goods' selling potential on Allegro, the recognizability of the Goods, and how often they are searched for by Buyers, the quality of the Goods (including the quality of the material from which they are made), whether the Goods have relevant certificates, shipping terms, the warranty period, the quantity of Goods in the Offer, the quality of the description, images, the Offer template, the value of products added to the Offer as freebies, specified in the Partner's Transactions.
The Company may at any time verify the requirements referred to in paragraphs 3, 4, 6 above. In the event of a negative outcome of the verification referred to in the preceding sentence, the Company may request the Partner to update the Offer so that it meets the requirements specified in the Terms & Conditions. Otherwise, the Partner will be excluded from the Campaign with immediate effect.
Regardless of the Partner meeting the terms specified in paragraphs 3, 4, 6 above, in justified cases, in particular, when the Partner:
a. Fails to comply with the Terms & Conditions or the Allegro Terms & Conditions, in particular, if such failure results in the Account being suspended, or in an excessive number of removed Offers, or transactional problems in relation to the sales volume;
b. Acts in a way that results in the loss of trust in the Partner, also in the case of a failure to meet the obligations related to the participation in the Program;
c. in a situation where sanctions have been imposed on the Partner for violation of the rules regarding the sale of illegal products under Article 8.4 of the Allegro Terms & Conditions.
The Company reserves the right to refuse to qualify the Partner for the Campaign or remove the Partner from the Campaign. In the situation referred to in the previous sentence, the Company will justify its decision at the request of the Partner.
The Company reserves the right to conduct a subsequent verification of the Offers qualified for the Campaign in terms of their attractiveness, on the basis of the criteria specified in paragraph 6 above, and to remove the Offers from the Campaign if they are no longer attractive in terms of their price compared to market prices and prices on Allegro.
The Company may remove the Partner from the Campaign and suspend the Partner's Account on Allegro without prior notice if the Partner has taken any steps to circumvent the security measures or falsifies data.
The Company reserves the right to amend and supplement these Terms & Conditions at any time. The changes will be announced and published at https://allegro.pl/dla-sprzedajacych. They will become effective on the date indicated by the Company. At the same time, until the proposed amendments become effective, the Partner may submit a termination (using the contact form) if the Partner does not accept those amendments. If the termination notice referred to in the preceding sentence is not delivered to the Company, the Partner will be deemed to have accepted the amendments to the Terms & Conditions.
All disputes arising from the provision of services in the Campaign will be settled by the common court proper for the Company's registered office.
Any matters not provided for in the Terms & Conditions are governed by the relevant provisions of the Deal Zone Terms & Conditions or the Allegro Terms & Conditions.
These Terms & Conditions have been drawn up in two language versions, Polish and English. In case of any discrepancies, the Polish version will take precedence.

If any Offers present Goods that constitute devices within the meaning of Article 1(2)(1) of the Act of April 7, 2022, on medical devices (Dz.U.2022.974), i.e., medical devices, medical device equipment, and products listed in Annex XVI to Regulation (EU) 2017/745 of the European Parliament and of the Council of April 5, 2017, on medical devices, amending Directive 2001/83/EC, Regulation (EC) No 178/2002 and Regulation (EC) No 1223/2009 and repealing Council Directives 90/385/EEC and 93/42/EEC, and in vitro diagnostic medical devices and in vitro diagnostic medical device equipment referred to in Regulation (EU) 2017/746 of the European Parliament and of the Council of April 5, 2017, on in vitro diagnostic medical devices and repealing Directive 98/79/EC and Commission Decision 2010/227/EU, they may participate in the Campaign only after the Partner has previously (before the launch of the Campaign) submitted a written statement in accordance with the Allegro Terms & Conditions (Section 10). This statement must be delivered by the Campaign start date to the Company address, i.e., Fabryka Norblina, budynek Galwan, ul. Żelazna 51/53, 00-841 Warszawa (marked WYROBY MEDYCZNE).
